These Terms and Conditions govern access to and use of www.myhomeware.co.za, including enquiries, quotations, customer accounts and purchases made through the website.
By accessing the website, creating an account, requesting a quotation or placing an order, you agree to these Terms and Conditions. If you do not agree, you should not use the website or place an order through it.
Nothing in these Terms and Conditions is intended to limit any rights that cannot lawfully be excluded under applicable South African legislation.

MyHomeware is a South African supplier of commercial catering equipment, professional kitchenware, tableware, glassware and foodservice products for chefs, caterers, restaurants, cafés, hotels, bakeries and other hospitality businesses.
MyHomeware supplies both business customers and, where applicable, individual consumers. Certain provisions of consumer protection legislation may apply differently depending on the identity of the purchaser, the size of the business and the nature of the transaction.

Use of the Website
You may use the website to browse products, obtain information, submit enquiries, request quotations, create an account and place orders.
You agree to use the website only for lawful purposes and in a way that does not infringe the rights of MyHomeware, its customers, suppliers or any third party.
You may not attempt to gain unauthorised access to the website, interfere with its operation, introduce malicious code, copy website data through automated means, impersonate another person, submit false information or use the website for fraudulent activity.
MyHomeware may suspend or restrict access to the website where misuse, fraud, security risks or unlawful activity are reasonably suspected.
Product Information
MyHomeware aims to provide accurate product names, images, descriptions, specifications, dimensions, capacities, prices and availability information.
Product photographs are provided for identification and illustration. Colours, finishes, packaging and minor product details may differ slightly from what is displayed due to supplier changes, screen settings, manufacturing updates or photography.
Dimensions, capacities, weights and output figures may be approximate unless expressly stated otherwise. Customers purchasing commercial equipment should request confirmation of important technical requirements before ordering.
MyHomeware may correct or update product information at any time.
Commercial Equipment Specifications
Commercial appliances may require specific electrical, gas, water, drainage, extraction, ventilation or installation arrangements.
Before placing an order, the customer is responsible for confirming that the product is suitable for the intended application and compatible with the premises.
This includes checking the available space, product dimensions, access routes, voltage, electrical phase, power supply, gas type, ventilation, plumbing, drainage and any installation requirements.
Where professional installation or certification is required, the equipment must be installed by a suitably qualified or authorised installer.
MyHomeware will not be responsible for incompatibility caused by a customer failing to confirm published or supplied specifications, except where MyHomeware expressly recommended a product for a purpose fully disclosed by the customer and applicable law provides otherwise.
Prices
Prices displayed on the website are quoted in South African rand.
The website or quotation will indicate where VAT is included or excluded. Delivery, installation, assembly and other service costs are not included unless expressly stated.
MyHomeware may change prices at any time before an order is accepted. A price change will not affect an order that has already been accepted and paid for, except where there is an obvious pricing error or another lawful basis for correction.
Pricing and Website Errors
MyHomeware takes reasonable care to display accurate pricing and product information. However, typographical, technical, supplier or system errors may occur.
Where a product is displayed at an obviously incorrect price or with materially incorrect information, MyHomeware may contact the customer before accepting or fulfilling the order.
The customer may be offered the option to proceed at the correct price or cancel the affected item for a refund.
MyHomeware will not knowingly enforce an incorrect price where doing so would be misleading or contrary to applicable law.
Product Availability
Products displayed on the website may be subject to stock availability, supplier availability and lead times.
Adding an item to a basket does not reserve the product. Availability is only confirmed once the order has been accepted or confirmed by MyHomeware.
Where a product becomes unavailable after an order is placed, MyHomeware will contact the customer and may offer a substitute product, revised lead time, store credit or refund.
A substitute will not be supplied without the customer’s approval where it materially differs from the product ordered.
Quotations
A quotation is valid for the period stated on it. Where no validity period is provided, the quotation remains subject to confirmation of pricing and availability before acceptance.
Quotations may be amended where supplier prices, exchange rates, taxes, transport costs, specifications or stock availability change before the order is accepted.
A quotation does not reserve stock unless MyHomeware confirms otherwise in writing.
The customer is responsible for reviewing the quotation, specifications, quantities, delivery information and total amount before accepting it.
Placing an Order
An order is submitted when the customer completes the website checkout or accepts a quotation through an approved method.
Submitting an order does not necessarily mean that MyHomeware has accepted it.
An order is accepted once MyHomeware sends an order confirmation, confirms acceptance in writing, receives the required payment or begins fulfilling the order, depending on the transaction.
MyHomeware may decline or cancel an order where the product is unavailable, payment is not authorised, information is incomplete, fraud is suspected, delivery is not reasonably possible or an obvious error has occurred.
Where payment has already been received for an order that MyHomeware cannot accept, the relevant amount will be refunded.
Customer Information
The customer must provide accurate and complete contact, billing, delivery and business information.
MyHomeware is not responsible for delays, failed deliveries or additional costs resulting from incorrect or incomplete information supplied by the customer.
The customer must inform MyHomeware promptly if any order or contact information changes.
Customer Accounts
Customers may be permitted to create an account to manage orders and account information.
You are responsible for maintaining the confidentiality of your password and account credentials.
You must notify MyHomeware promptly if you suspect unauthorised use of your account.
MyHomeware may suspend or close an account where there is evidence of fraud, misuse, unlawful activity or a security risk.
Payment
Available payment methods will be displayed during checkout or stated on the quotation or invoice.
Orders may only be processed once the required payment has been received and cleared, unless written credit terms have been approved.
The customer is responsible for using the correct payment reference and paying the full amount due.
Bank charges, payment-provider costs or foreign payment charges are the customer’s responsibility unless otherwise agreed.
MyHomeware may withhold dispatch until payment has been confirmed.
Credit Terms
Credit facilities are only available where expressly approved by MyHomeware in writing.
Approval of credit terms may be subject to credit checks, supporting documents, credit limits and additional terms.
Late or unpaid amounts may result in suspension of further orders, withdrawal of credit facilities and recovery action, subject to applicable law and the agreed credit terms.
Delivery
Delivery availability, charges and estimated timeframes depend on the destination, product type, stock status, supplier lead time, order size and courier requirements.
Any delivery timeframe is an estimate unless MyHomeware expressly agrees in writing to a guaranteed date.
MyHomeware will take reasonable steps to deliver within the communicated timeframe but is not responsible for delays outside its reasonable control.
The customer must ensure that someone authorised to receive the order is available at the delivery address.
Delivery Access
The customer is responsible for confirming that the delivery site is accessible.
This includes checking doorways, passages, staircases, lifts, loading areas, security access, parking restrictions and any equipment required to offload large or heavy items.
Standard delivery may only include delivery to an accessible ground-level location unless another service has been agreed.
Additional charges may apply where special vehicles, lifting equipment, extra labour, redelivery or difficult access is required.
Inspection on Delivery
The customer should inspect the order as soon as reasonably possible after delivery.
Visible damage, shortages or incorrect products should be recorded with the courier where possible and reported promptly to MyHomeware.
The customer should retain the products, packaging and delivery documentation while the matter is assessed.
Signing a delivery document does not remove any statutory rights, but customers should record visible damage or missing items before signing where practical.
Risk and Ownership
Risk of loss or damage generally passes to the customer when the goods are delivered to the agreed address or collected by the customer or its appointed carrier, subject to applicable law and any written agreement stating otherwise.
Ownership of the goods remains with MyHomeware until full payment has been received, where legally enforceable.
The customer may not sell, pledge or dispose of unpaid goods in a manner that defeats MyHomeware’s lawful ownership rights.
Collection Orders
Where collection is available, MyHomeware will notify the customer when the order is ready.
The customer or authorised representative may be required to provide identification, an order reference or written authority before goods are released.
Goods should not be collected until MyHomeware has confirmed that they are ready.
Cancellations
Customers should contact MyHomeware immediately when requesting cancellation.
An order may be cancelled before dispatch where it has not yet been processed, ordered from a supplier, customised, assembled or handed to a courier.
Special-order, customised, imported-on-request or supplier-confirmed products may not be cancellable once procurement or production has begun, unless cancellation is required by law or accepted by MyHomeware in writing.
Any lawful online cooling-off rights are addressed in the Returns and Refunds Policy.
Returns, Refunds and Exchanges
Returns, refunds, exchanges, damaged deliveries, defective products and warranty claims are governed by the MyHomeware Returns and Refunds Policy.
That policy forms part of these Terms and Conditions.
Where applicable legislation grants the customer rights beyond the policy, the legislation will apply.
Warranties
Products may carry a manufacturer or supplier warranty. Warranty periods and conditions differ between brands and products.
Warranty cover may require proof of purchase, serial or model information, correct installation, suitable utilities, proper operation and compliance with maintenance requirements.
Damage caused by misuse, incorrect installation, unsuitable electrical or gas supply, unauthorised repairs, accidents, neglect, overloading or failure to maintain the product may fall outside warranty cover.
Manufacturer warranties are additional to any statutory rights that apply.
Special Orders
A special order includes a product sourced, manufactured, imported, engraved, personalised, altered or ordered specifically for a customer.
Special orders may require full payment or a non-refundable deposit before procurement begins.
Once confirmed, a special order may not be cancelled or returned because the customer changed its mind, except where required by law or agreed in writing.
Special-order lead times are estimates and may depend on manufacturers, importers, shipping, customs and other third parties.
Bulk and B2B Orders
Bulk orders and business-to-business transactions may be subject to separate quotations, payment terms, delivery arrangements, minimum quantities, supplier lead times and cancellation conditions.
Where a written quotation, supply agreement, credit agreement or purchase order contains terms that differ from these general Terms and Conditions, the specifically agreed written terms will apply to the extent of the inconsistency.
Where the Consumer Protection Act does not apply to a business customer or transaction, the parties’ contractual terms will govern the purchase.
Resale and Trade Purchases
Unless expressly agreed otherwise, the customer is responsible for ensuring that products purchased for resale are suitable for its market and comply with any obligations applicable to the customer as reseller.
The customer may not alter branding, make unsupported product claims or represent itself as an agent of MyHomeware without written permission.
Intellectual Property
The website and its content, including text, graphics, layouts, logos, product arrangements, photographs and design elements, are owned by or licensed to MyHomeware.
You may view and use the website for personal or legitimate business purchasing purposes.
You may not reproduce, republish, distribute, scrape, modify or commercially exploit website content without prior written permission, except where permitted by law.
Third-party trademarks and brand names remain the property of their respective owners.
Product Reviews and Submitted Content

Limitation of Liability
To the maximum extent permitted by law, MyHomeware is not liable for indirect, incidental, special or consequential loss arising from use of the website or products, including loss of profit, revenue, opportunity, production or business interruption.
This limitation does not exclude liability that cannot lawfully be excluded, including liability arising from gross negligence or rights and remedies protected by applicable consumer legislation.
Where MyHomeware is lawfully entitled to limit liability in a business-to-business transaction, its total liability will not exceed the amount paid for the specific product or service giving rise to the claim, unless otherwise agreed in writing.
Indemnity
To the extent permitted by law, you agree to indemnify MyHomeware against losses, claims or expenses resulting from your unlawful use of the website, breach of these Terms and Conditions, infringement of third-party rights or misuse of products.
This provision does not require a consumer to waive rights or remedies that cannot lawfully be waived.
Events Outside Our Control

MyHomeware will take reasonable steps to communicate material delays and find a practical solution.
Complaints
Customers should submit complaints to sales@myhomeware.co.za with their order or invoice number and details of the issue.
MyHomeware will take reasonable steps to investigate and respond.
Nothing in these Terms and Conditions prevents a customer from approaching a regulator, ombud, court or other dispute-resolution body where entitled to do so.
Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
Any dispute will be dealt with by a court or other forum with lawful jurisdiction, subject to any consumer right to approach an appropriate tribunal, regulator or alternative dispute-resolution body.
Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.
The invalid provision will be interpreted or adjusted only to the extent necessary to make it lawful and enforceable.
No Waiver
A failure or delay by MyHomeware in enforcing a right does not mean that the right has been waived.
Any waiver must be given in writing and applies only to the specific circumstances for which it was granted.
Entire Agreement
These Terms and Conditions, together with the applicable quotation, invoice, order confirmation, Returns and Refunds Policy, Privacy Policy and any written transaction-specific terms, form the agreement between MyHomeware and the customer.
Where transaction-specific written terms conflict with these general terms, the transaction-specific terms will take priority.
Changes to These Terms
MyHomeware may update these Terms and Conditions to reflect changes to the website, products, services, business practices or applicable law.
The latest version will be published on this page with an updated revision date.
Changes will not retrospectively alter an order already accepted unless required by law or agreed by the parties.
